This matter has come-up on an application (IA No. 03/2021)

for reconstitution of the S.B Civil Regular First Appeal No.

1115/2019 titled as Smt. Pushpa Devi vs Prem Devi & Ors.

It has been submitted that in the above noted appeal, this

Hon'ble Court was pleased to issue notice to respondents and the

same was served upon them and record of the case was also

called for. Therefore, the same has been fixed for admission in

the notice served category on 22.07.2021 but the file of the case

is missing.

In the present case, the execution proceedings are going on.

The appellant also submitted search application but despite the

search slip issued by the office, the file could not be traced out.

The appellant has an urgency as the execution proceedings are

pending. Hence, it is prayed that reconstitution of the file may be

ordered. The copy of the memo of appeal as well as of the

judgment of the learned court below is also filed herewith.

                                          Considering the submissions made by the parties,              office is

directed to reconstitute the file mentioned above and list the

matter on 02.08.2021.
