1. Petitioner has filed this bail application under Section 439

Cr.P.C.

2. F.I.R. No.311/2020 was registered at Police Station Sewar,

District Bharatpur for offence under Section 304-B I.P.C.

3. It is contended by counsel for the petitioner that from the

evidence of the neighbours, it is evident that a dispute took place

with regard to petitioner consuming gutka. It is also contended

that the deceased committed suicide as she was not happy with

the petitioner as he was consuming too much gutka.

4. Learned Public Prosecutor has opposed the bail application. It

is contended that deceased got married to the petitioner on

15.04.2019 and she died on 07.08.2020 i.e. within one year and

four months of the marriage. There is evidence of the complainant

that the deceased called her on 06.08.2020 at around 9:00pm and

informed the complainant that she is being subjected to beating

by the family members and demanding Rs.2,00,000/-.From the

CDR, the factum that there being a talk between the complainant

and father of petitioner is established, which goes to show that

whatever the complainant is saying has some truth.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the

State, I am not inclined to entertain the bail application.

7. This bail application is, accordingly dismissed.

8. However, petitioner would be free to move fresh bail

application after recording of the statement of complainant in the

Court.
