1. Petitioner has filed this bail application under Section 439

Cr.P.C.

2. F.I.R. No.291/2020 was registered at Police Station Bandikui,

District Dausa for offence under Sections 457, 376(2)(n) & 506

I.P.C.

3. It is contended by counsel for the petitioner that prosecutrix

initially lodged a complaint, which was later on withdrawn by her.

Thereafter, she lodged an F.I.R. against the petitioner, in which she

submitted compromise before the Court and the F.I.R. was got

quashed, thereafter the present F.I.R. has been lodged. It is also

contended that petitioner has also filed a complaint with regard to

honey trap. There is inordinate delay in lodging of the present

F.I.R. It is further contended that petitioner was put under

pressure and some amount was taken by the prosecutrix. Now

prosecutrix is demanding house and to put pressure on petitioner,

the present F.I.R. has been lodged. Prosecutrix is a married lady,

having children.

4. Learned Public Prosecutor and counsels for the complainant

have opposed the bail application. It is contended that petitioner is

continuously threatening the prosecutrix. He has committed rape

with her and he is continuing with the said offence and prosecutrix

has come to move an application under Section 482 Cr.P.C.,

seeking protection.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the

petitioner, I deem it proper to allow the bail application.

7. This bail application is, accordingly, allowed and it is directed

that accused-petitioner shall be released on bail provided he

furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees

One Lac only) together with two sureties in the sum of

Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction

of the trial Court with the stipulation that he shall appear before

that Court and any Court to which the matter be transferred, on

all subsequent dates of hearing and as and when called upon to do

so.
