Heard. Perused the material available on record.

The convict petitioner Ranjeet Singh, S/o Sh. Ishwar Singh

has been granted third parole of forty days by the District Parole

Advisory Committee, Banswara vide recommendations recorded

in the meeting of the District Parole Advisory Committee, Banswra

held on 07.01.2021 whereby he has been directed to furnish a

personal bond in the sum of Rs.50,000/- and two sureties in the

sum of Rs.25,000/- each as a pre-requisite condition for being

released on parole. The convict-petitioner has forwarded this

letter petition from jail seeking relaxation/waiver in the condition

of furnishing surety bonds in terms of the order of the District

Parole Committee owing to his poor financial position.

Shri Farzaznd Ali, learned AAG has placed on record the

factual report as per which pursuant to the order dated

18.07.2019 passed in D.B. Criminal Writ Petition No.270/2019, the

convict-petitioner had satisfactorily availed second parole of thirty

days upon furnishing a personal bond in the sum of Rs.50,000/-.

Thus, having regard to the overall facts and circumstances of

the case and keeping in view the fact that the petitioner has

already availed second parole upon furnishing a personal bond,

without any complaint whatsoever and as now, because of his

family being in dire financial condition, he is unable to furnish the

surety bonds despite parole being sanctioned to him, we deem it

proper to release the petitioner Ranjeet Singh, S/o Sh. Ishwar

Singh on third parole of thirty days by relaxing the condition of

furnishing two surety bonds as imposed by the District Parole

Advisory Committee in its recommendations dated 07.01.2021.

Thus, the requirement of furnishing two surety bonds is waived.

He shall mark his attendance at the Police Station Garhi, Banswara

every seventh day after his release on parole. The other

conditions as imposed by the Committee qua the convict petitioner

are maintained.

The writ petition is allowed, accordingly.
