The second parole application of the convict-petitioner has

been dismissed vide adverse recommendations dated 22.04.2021

passed by District Parole Advisory Committee, Jalore assigning a

reason that at that particular point of time, the Covid pandemic

was spreading fast and the "self-discipline fortnight" was being

observed in the State of Rajasthan and thus, it was not considered

expedient in the interest of justice to release the convict on

parole. The next meeting was scheduled to be held on 3 rd Monday

of May, 2021.

Now, the Covid infections have receded significantly but the

convict-petitioner has still not been considered for release on

second parole. We therefore, direct that the District Magistrate,

Jalore shall objectively re-consider the case of the present

petitioner for grant of second parole of 30 days keeping in view

this Court's judgment in the case of Smt. Indra Kanwar vs State of

Rajasthan & Ors. (D.B. Criminal Writs No.17/2019) decided on

12.02.2019. Requisite order in this regard shall be passed within

next ten days.

Copy of this order shall be transmitted to District Collector,

Jalore forthwith.

List on 27.07.2021 for receiving the compliance report.
