This bail application has been filed by the petitioner under

Section 439 Cr.P.C. in connection with FIR No.278/2020 registered

at Police Station, Bhichiwada, District Dungarpur for offence under

Sections 147, 148, 149, 341, 323, 332, 353, 327, 394, 435, 188,

269, 270, 222, 283, 307, 397, 384, 336, 427, 436, 455, 120B IPC

read with Sections 3, 4 PDPP Act, Section 8-B of National Highway

Authority Act and Section 51 of the Disaster Management Act.

Heard learned counsel for the petitioner as well as learned

Public Prosecutor and perused the entire material available on

record.

Learned counsel for the petitioner submits that the co-

accused have already been released on bail.

Learned Public Prosecutor has opposed bail to the petitioner.

                                        Taking    into    consideration          the     over         all    facts,   without

commenting on merits of the case, I am inclined to release the

petitioner on bail.

Accordingly, this bail application is allowed and it is ordered

that the accused petitioner - Devendra s/o Vallabh Ram be

released on bail under Section 439 Cr.P.C. in connection with

aforesaid FIR No.278/2020 registered at Police Station,

Bhichiwada, District Dungarpur provided the petitioner furnishes a

personal bond of Rs.20,000/- with one surety in the like amount,

to the satisfaction of the concerned Magistrate with the stipulation

that he shall comply with all the conditions laid down under

Section 437 (3) CrPC.
