This application for anticipatory bail under Section 438 CrPC

has been filed by the petitioner in connection with FIR No.57/2021

registered at Police Station Salumbar, District Udaipur for offence

under Sections 420, 408 IPC.

Heard learned counsel for the petitioner as well as learned

Public Prosecutor and perused the material available on record.

Learned counsel for the petitioner submits that he was

earlier arrested and released on bail and thereafter present case

has been registered against him and he is sought to be arrested.

The interim bail was granted to the petitioner with direction

to appear before the Investigation Officer. The Investigation

Officer has submitted report that recovery is required to be

effected with regard to allegations in the FIR.

Looking to nature of the allegations, where there is a fraud

and stealing of silver and gold as well as report of the

Investigation Officer, I am not inclined to allow the benefit of

anticipatory bail to the petitioner.

The bail application is dismissed.
