(1) By way of the present writ petition, the petitioner has

challenged the order dated 7.10.2020, whereby petitioner's

request for compassionate appointment has been rejected.

(2) Admittedly, the petitioner's father Sh. Prem Shanker Ameta,

who was in Government service retired on 31.8.2020 - on

attaining age of superannuation (60 years) and died on 4.9.2020,

i.e., after four days' of his superannuation.

(3) In the opinion of this Court, the provisions of Rajasthan

Compassionate Appointment of Dependents of Deceased

(2 of 2) [CW-6247/2021]

Government Servant Rules, 1996 apply to the employees who die

in harness or in-service employees. Since father of the petitioner

passed away as a retired employee (after his superannuation), the

petitioner cannot claim compassionate appointment under the

Rules of 1996.

(4) This court does not find any merit in the present writ

petition, for which it is hereby dismissed.

(5) The stay application also stands disposed of accordingly.
