Learned counsel for appellant/applicant has submitted that

the appellant/applicant is in Judicial custody for the last six years.

The appellant/applicant has been falsely involved in this case.

Learned State Counsel, who is assisted by the counsel for

the complainant has opposed the application.

Present case relates to the murder of Jhandu Ram. Case

rests on eye witness account. PW-3-Bhataram, eye witness, has

duly supported the prosecution case, during trial.

Keeping in view the seriousness of allegations levelled

against the appellant/applicant, no ground for suspension of

sentence during the pendency of appeal is made out.
