Heard learned counsel for the parties.

From the FIR as well as other documents available on record,

it appears that the allegations against the petitioners are to the

effect that they formed an unlawful assembly and thereafter

attacked the police party, which came to the house of Heera Lal

for investigation in connection with the matrimonial dispute.

Having regard to the totality of the facts and circumstances

of the case and looking to the nature of accusation and gravity of

the offence, without expressing any opinion on the merits of the

case, I am not inclined to grant bail under Section 438 Cr.P.C. to

the petitioners.

Hence, the instant bail application filed by the petitioners

under section 438 Cr.P.C. is dismissed.

However, the petitioners are free to surrender before the trial

court.
