This appeal is directed against the judgment of the learned
single judge dated 26/08/2021. The appellant had moved an
application for impleadment in Civil Writ Petition No.20951/2019.
The petition has been filed by District Basketball Association,
Alwar in which the petitioner had challenged an order dated
27/09/2019 passed by Registrar Co-operative Societies
superseding the existing management committee of association
and substituting with newly formed adhoc committee. The
petitioner is another member of the adhoc committee. The learned
single judge has entertained the petition and stayed this order.
When the appellant filed an application for impleadment the same
was dismissed by the learned single judge by the impugned order
with cost.
We do not find that the learned single judge has committed
any error in not allowing the application for impleadment in the
writ petition filed by the association challenging the action of the
Registrar Cooperative Societies. The appellant merely by virtue of
being one of the member of the proposed adhoc committee
constituted by the Registrar, Cooperative Societies has no direct lis
with the pending dispute.
Under the circumstances, appeal is disposed of without
disturbing the order of the single judge but deleting the cost
imposed on the petitioner.
