HON'BLE MR. JUSTICE INDERJEET SINGH Order 09/12/2021
Counsel for the petitioner submits that the proceedings
initiated by the Department against the petitioner is barred by
Sub-section 3 of Section 46 of Food Safety and Standards Act,
2006. Counsel further submits that second RFL report was
received on 30.12.2014, whereas the life of the product expired
on 07.12.2014 and prayed for quashing of the complaint.
In support of his contention counsel relied on the judgments
passed by the Madras High in the matter of M. Mahadevan Vs.
Food Safety Officer reported in 2017 (2) FAC 498 &
Dayachand Vs. The State of Madhya Pradesh reported in
2017 (1) FAC 253.
In that view of the matter, list this matter in the first week of
February, 2022.
Meanwhile, further proceedings pending before the trial
Court in criminal complaint No. 5588/2018 shall remain stayed.
