1. In the present case, the District Supply Officer, Chittorgarh,

vide order dated 18.08.2021 suspended petitioner's license for

operating fair price shop.

2. It is the assertion of the petitioner that since 18.08.2021, no

notice has been received by the petitioner and a period of more

than 90 days has since passed.

3. Mr. Shrimali, learned counsel for the petitioner relies upon

judgment dated 02.06.2020 passed by this Court in SB Civil Writ

Petition No.4359/2020 : Ganpat Lal Vs. State of Rajasthan & Anr.

and submits that the period of suspension cannot travel beyond

90 days as per the provisions of Order No.8(2) of the Rajasthan

Food Grains & Other Essential Articles (Regulation of Distribution)

Order, 1976.

4. Matter requires consideration.

5. Issue notice. Issue notice of stay application also, returnable

within six weeks.

6. Meanwhile, effect and operation of the order dated

18.08.2021 shall remain stayed.

7. Needless to observe that after due enquiry, if any order

cancelling petitioner's license is passed, present interim order

shall automatically come to an end.
