Counsel for the petitioner seeks withdrawal of writ petition

on behalf of petitioner No.2- Balchand Meena, with liberty to file

same before the competent court.

In view of submissions made, the writ petition filed on behalf

of petitioner No.2- Balchand Meena, is dismissed as withdrawn

with liberty as aforesaid.

It is submitted by learned counsel for the petitioner No.1

that the relief as claimed by the petitioner is squarely covered by

the Division Bench decisions of this Court in Narendra Singh

Shekhawat & Ors. v. State of Rajasthan & Ors. : D.B. Civil Writ

Petition No.12294/2016, decided on 01.05.2017 and Priyadarshi

Bohra & Ors. v. State of Rajasthan & Ors. : D.B. Civil Writ Petition

No.8063/2016, decided on 10.04.2017.

Further submissions have been made that though the

petitioner has made a representation (Annex.4) to the

respondents, the same has not been decided and the petitioner

has not been accorded the benefit to which he is entitled in view

of the judgment in the case of Narendra Singh Shekhawat (supra)

and Priyadarshi Bohra (supra).

In view of the submissions made, the writ petition filed by

the petitioner No.1 is disposed of. The respondents are directed to

decide the pending representation of the petitioner and in case, it

is found that the petitioner is entitled to the relief as claimed,

accord the same in accordance with law.

Needful may be done by the respondents within a period of

six weeks from the date a copy of this order is placed by the

petitioner with the respondents.

The petitioner No.1 would be free to file a fresh detailed

representation, if so advised.
