Learned Public Prosecutor has submitted that he has already
filed reply to the application for suspension of sentence.
Office to check and place the same on record.
Copy of the reply be also supplied to learned counsel for the
appellant.
It is noticed that as per the impugned judgment, age of the
child victim was 15 years at the time of incident.
As per amended provision of Section 439 (1A) of Cr.P.C. in
any application for bail made on behalf of accused, hearing the
informant or any other person authorized shall be obligatory if
victim's age is less than 16 years on the date of incident. In such
circumstances, learned counsel for the appellant is directed to
implead first informant/complainant has party respondent in
appeal as well as in application for suspension of sentence within a
period of ten days.

On impleading the same, let notices be issued to the newly
impleaded respondent, returnable within six weeks, thereafter.
