After arguing the matter at great length, learned counsel Shri Bhagirath Ray Bishnoi craves to withdraw the instant criminal misc. petition, seeking leave that as the petitioner apprehends arrest in this case, he may be given liberty to approach the appropriate court by way of an anticipatory bail application under Section 438 Cr.P.C. In the peculiar facts of the case, it is observed that the application for pre-arrest bail, if any, filed on behalf of the petitioner be considered objectively and sympathetically keeping in view his old age.
The instant misc. petition is dismissed as withdrawn with the liberty prayed for. The stay application is also dismissed.
