1. Learned counsel for the petitioner submits that the

controversy involved in the present case is squarely covered by

the judgment dated 12.04.2017 passed by Jaipur Bench of this

Court in the case of Rajkumar Agrawal Vs. State of Rajasthan &

Ors. (SB Civil Writ Petition No.5400/2015), followed by bunch of

cases by Coordinate Bench of this Court led by Laxmi Narayan

(2 of 2) [CW-9297/2021]

Sharma Vs. State of Rajasthan & Ors. (SB Civil Writ Petition

No.15625/2017), decided on 11.07.2018.

2. Mr. Chouhan, learned counsel for the respondents, is not in a

position to dispute the aforesaid facts and law.

3. In view of the aforesaid, the present writ petition is allowed.

The order dated 24.12.2018 (Annex.6) is hereby quashed and set

aside.

4. The petitioner's case for payment of retiral dues and pension

shall be considered while treating him in pay scale of Rs.5000-

8000/-.

5. The stay application also stands disposed of accordingly.
