Learned counsel for the petitioner submits that after

processing the disputed mutation entry (which has since been got

reversed/rectified), the land in question was got mortgaged with

the bank and that the petitioner is ready and willing to clear off

the dues of the bank. He further submits that the possession of

the land to which the complainant is entitled shall be restored to

her.

Last opportunity is granted to the petitioner for complying

with the said undertaking. The petitioner shall clear off the bank

dues towards mortgage of the disputed land and shall hand over

vacant possession of the share of the complainant to her by the

next date of hearing. The interim order is being continued till next

date subject to this assurance given by the petitioner's counsel.

Learned Public Prosecutor shall return the case diary to the

IO alongwith copy of this order who shall verify the fact whether

the possession of the land in question has been given to the

complainant and whether loan account has been cleared off or

not.
