                                                                 ----Respondents

For Petitioner(s) : Mr. Dinesh Ojha

                     JUSTICE DINESH MEHTA

                                     Order

04/08/2021

1. Concededly, petitioner having secured 59.948% marks, does

not fall in the merit list in revised select list issued on 11.01.2021,

issued by the respondents.

2. It is the contention of the petitioner that there are certain

other candidates, who have already been appointed and/or who

have not fulfilling the criteria and, thus, respondents should

comply with the directions given by this Court in the case of

Kuldeep Kumar & Ors. Vs. State & Ors. : S.B. Civil Writ Petition

No.2094/2019, decided on 20.07.2020, in its entirety.

3. It is to be noted that the aforesaid judgment in Kuldeep

Kumar (supra) has been reviewed suo-moto vide order dated

25.02.2021 and the State is expected to comply with the

directions given in Kuldeep Kumar (supra) so also the order in

review petition. If such exercise is done, the petitioner would

(2 of 2) [CW-10016/2021]

certainly be considered. But no direction to implement/comply

with the direction in Kuldeep Kumar's case can be issued.

4. The writ petition is, therefore, not entertained at this stage.

5. Needless to observe that if any fresh cause of action accrues

to petitioner, the petitioner will be free to file fresh writ petition.

6. Stay petition also stands disposed of accordingly.
