Heard learned counsel for the appellant.
The following substantial questions of law arises for
consideration in the present appeal:-
1. Whether the two courts below were justified in
coming to the conclusion that in view of
judgment dated 11.10.1984 passed in Suit
No.20/1977 (Exhibit-11) and decree (Exhibit-12),
the plaintiff was not required to seek declaration
regarding the suit property when appellant -
defendant No.1 was not a party to the said suit?
2. Whether the findings recorded by the two courts
below are based on non-reading /
misinterpretation of the judgment and decree
dated 11.10.1984 (Exhibit-11 and 12)?
3. Whether the two courts below were justified in
coming to the conclusion that the suit for
possession and mesne profit was maintainable
without seeking declaration and cancellation of
the sale deed in favour of the appellant -
defendant No.1?
Admit. Issue notice. Issue notice of the stay application also,
returnable within a period of eight weeks.
Notices when issued be given 'dasti' to learned counsel for
the appellant.

In the meanwhile and till further orders, status quo
pertaining to the title and possession of the suit property shall be
maintained by the parties.
