Heard learned counsel for the appellant.

Learned counsel for the appellant stated that award has been

passed according to guidelines laid down in the judgment

pronounced by Hon'ble the Apex Court in the case of "National

Insurance Co. Ltd. Vs. Pranay Sethi & Ors." as this is proved in

finding of issue No.3. He further stated that the F.I.R. has been

lodged after a delay of two months of the incident and the same

has not been considered by learned Tribunal.

Admit. Issue notice to the respondent, rule is made

returnable within a period of four weeks.
