1. All the Civil Revision Petitions are taken up together for final
disposal since the issue involved in all these cases is similar.
2. Learned counsel for the petitioner-NHAI submitted that the prayer
made in all these Civil Revision Petitions is for issuance of appropriate
directions to the concerned learned District Judge for expeditious disposal of
the applications under Section 36(2) of the Arbitration and Conciliation Act,
1996, filed in the objection petition under Section 34 of the Act, which are
pending adjudication. He further submitted that during the pendency of the
present petitions, a Standard Operating Procedure (SOP) has been issued by the
petitioner-NHAI, wherein it has been decided that instead of filing petitions
under Article 227 of the Constitution of India for seeking expeditious disposal
of the pending applications under Section 36(2) of the Arbitration and
Conciliation Act, 1996, the National Highways Authority of India (NHAI) will
first approach the concerned Court of the District Judge for seeking expeditious
disposal and in the present cases also, the petitioner-NHAI has already filed
appropriate applications before the concerned Court for seeking expeditious
disposal of the applications under Section 36(2) of the Act, which are still
pending.
3. After hearing the learned counsel for the petitioner, this Court is of
the considered view that since during the pendency of the present petitions, the
petitioner-NHAI has already moved the applications before the concerned Court
seeking expeditious disposal of the applications under Section 36(2) of the
Arbitration and Conciliation Act, 1996 and as the relief claimed in the present
authenticity of this order/judgment.
CR-885-2026 and other connected cases -11-
Civil Revision Petitions is identical, no further orders are required to be passed
by this Court.
4. Consequently, the present Civil Revision Petitions are dismissed, at
this stage.
5. A photocopy of this order be placed on the files of other connected
cases.
