CRM-16181-2026 I. This is an application filed u/s 528 of BNSS, 2023, for filing amended memo of parties, in compliance of this Court order dated 02.04.2026.

II. Allowed as prayed for. Amended memo of parties filed along with application is taken on record. Office to tag the same at appropriate place.

                      III.          CRM stands disposed of.

1. Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:-

2. After hearing learned counsel for the petitioner, on 02.04.2026, following order was passed by this Court:-

"2. According to the prosecution, a sum of Rs.25 Lakhs was JAWALA RAM transferred in the bank account of a firm namely M/s TSP Overseas,

Kandiwali, West Mumbai, which allegedly, further siphoned off, by the petitioner in the account technically belonging to co-accused Rahul Deepak Thakur.

When co-accused Rahul Deepak Thakur was arrested, he suffered a disclosure statement to the effect that he himself is a school-bus driver and his own account No.0417xxx1632 with Yes Bank, has been sold for its use to the petitioner for all intent and purposes. It was petitioner- Akash Gopal Revankar, who used to operate the bank account of co- accused Rahul Deepak Thakur.

3. Learned counsel for the petitioner argues that, in fact, there is no such evidence except of the disclosure statement, which is inadmissible as per law. No reliance can be placed on such a disclosure statement suffered by co-accused, who in all possibilities, cannot appear before the trial Court as a witness of prosecution. Moreover, the petitioner, being innocent, is ready to join investigation.

4. Notice of motion.

5. On advance notice, Mr. Amish Sharma, AAG, Haryana, puts in appearance on behalf of the respondent - State, and seeks time to give clarification on the submission addressed by the petitioner.

6. Mr. Jitender Singh Dawal, Advocate has put in appearance on behalf of the complainant. On his oral request, complainant-Pawan Kumar Nagpal is ordered to be impleaded as party respondent No.2 in the present petition. Let amended memo of parties be placed on the record before the Registry by the petitioner's counsel within five days from today. Memorandum of appearance filed on behalf of newly added respondent No.2/ complainant is taken record. Office to tag the same at an appropriate place.

7. Adjourned to 17.04.2026.

8. Till the next date of hearing, petitioner shall not be arrested. However, the issue of the petitioner joining investigation will be examined after considering the reply of the respondent."

3. Today, learned State counsel has filed the status report dated 28.04.2026 in Court today, which is taken on record. Office to tag the same at appropriate place.

A copy thereof has been handed over to the counsel for the petitioner.

4. Learned State counsel reads out paragraph No.11 of the status report and submits that as per the bank record, an amount of Rs.25.00 lakhs is found transferred through RTGS to accused Rahul Deepak Thakur in his Bank Account No.041763700001632 (TSP Overseas, Kandivali, Mumbai).

Further, in paragraph No.12, it is explained that when co- accused - Rahul Deepak Thakur was arrested on 28.08.2025, and was joined in the investigation, he though admitted his guilt, but disclosed that it was the petitioner, who had been operating his Bank Account.

5. Learned State counsel further refers to paragraph No.18 of the

status report, which reflects that during investigation also, it was revealed out that TSP Overseas had made several transactions with several ofther fake firms/companies, and out of which, some of the companies are as under:-

                                   (i)     Limco Logistics Private Limited;
                                   (ii)    Flexoni Global Private Limited;

(iii) Gulf Forex & Travels Private Limited; and

(iv) Classic Logistics.

All these firms/companies were found fake as per online record of the ROC website.

6. Besides, paragraph No.20 of the status report reads as under:-

"20. That role of the petitioner/accused is that he in collusion with Surekha Bangia grabbed Rs. 68,50,000/-. Accused Surekha Bangia had transferred 25,00,000/- in the account of M/s TSP Overseas. Accused Rahul Deepak Thakur is proprietor of said firm and he had sold the account of said firm to accused Akash Gopal Revankar. The petitioner/accused was operating the bank account of M/s. TSP Overseas. Accused Rahul Deepak Thakur has clearly revealed said facts in his disclosure statement. The petitioner/accused is also connected with group of fraudsters. Name of petitioner/accused has been cropped up in the disclosure statement of co-accused Rahul Deepak Thakur (Annexure R-1), which prima-facie, proves his involvement in the present case."

On perusal of the investigation, as reflected in the status report filed by the State, this Court is of the considered view that in order to ascertain the actual role of the petitioner, he is required to join the investigation. His custodial interrogation also appears necessary on certain aspects for effective and complete investigation so as to reach the truth.

There are serious allegations that the petitioner was operating the bank account of M/s TSP Overseas, through which multiple transactions have been effected with other fake firms/companies. In such circumstances, this Court does not find any ground to consider the plea of anticipatory bail of the petitioner at this stage.

Otherwise also, for proper investigation in such matters, which are rapidly increasing not only in the country but also globally, effective investigation can be conducted only by interrogating the accused persons, who are allegedly involved in such activities of cyber crime in different manners.
