Petitioners seek quashing of FIR No. No.123 dated 07.07.2022,,
under Sections Section 323, 406, 498-A, A, 506 and 34 of Indian Penal Code, Police
Station Rewari Sadar, District Rewari, Rewari and all subsequent proceedings
arising therefrom, on the basis of compromise dated 10.02.2026 said to be
arrived at between the parties. Section 34 IPC has been deleted from the
FIR during investigation.
2. On 19.03.2026,, this Court directed the parties to appear before
learned trial Court/Illaqa Magistrate for recording of their sta statements tements with
regard to compromise.
3. In compliance of the aforesaid order, parties appeared before
learned Judicial Magistrate Ist Class, Rewari Rewari, on 03.04.2026. Statement tement of
Investigating officer- L/ASI Papita, No.48/RWR, presently posted at Police

Station Sadar, Rewari, Rewari was recorded on 04.04.2026. Learned Judicial
Magistrate Ist Class, Rewari, has submitted her report recording satisfaction
that all the parties have entered into a valid compromise without any
influence or coercion. The relevant part of the report as under has been
submitted:
" 1. Number of accused arraigned in the FIR.
Ans. There are three accused namely Lalit, Vineet and Sunil Devi.
2. Number of accused who have appeared before the Trial Court and made statements statements?
Ans. Only one accused has appeared i.e. Lalit for recording the statement.
3. Whether during investigation, any additional accused has been added and he/she is a party to the compromise?
Ans: No, no other additional accused has been added,
4. Whether any of the accused is an absconder/proclaimed persons(s)?
Ans. No, accused Lalit is not absconder/proclaimed person.
5. Whether after the registration of the FIR, any offence was added or deleted during investigation?.
Ans: No other offence was added af after ter registration of FIR during investigation however Section 34 of IPC was deleted while submission of final report.
6. Whether Investigation is pending against any of the accused or any accused has been declared as innocent?
Ans: No investigation is pending ding against any accused and two accused namely Vineet and Sunil Devi has been found innocent during investigation.
7. Name(s) of the complainant and injured/aggrieved.
Ans: Asha Rani.

8. Whether all injured/aggrieved have appeared and their statements recorded?
Ans: Yes there is only one aggrieved person i.e. complainant whose statement has been recorded.
9. The stage at which the trial is pending?
Ans: The trial is proceedings in prosecution evidence.
10. Satisfaction of the Trial Court that the ccompromise ompromise is genuine, voluntary and out of free will of the parties?
Ans: The complainant and the accused have voluntarily entered into compromise without any undue influence and coercion. Thus, in my considered opinion the compromise between the two is ggenuine enuine as the complainant has no objection in quashing the FIR against accused.
11. Whether any other criminal case or proceedings is pending against the accused?
Ans: As per the statement of IO no other case is pending against the accused.
12. Whether any ny I.O. appeared or not and if appeared, his/her statement be recorded or not?
Ans: Yes IO L/ASI Papita No.48/RWR had appeared and her statement is recorded which has been reproduced in this report."
4. Learned State counsel and learned counsel for respondent No.2
have not raised any dispute regarding the factum of compromise. Since the
matter has been amicably resolved, continuation of the criminal proceedings
would be an exercise in futility. The dispute which has its genes genesis is in a
matrimonial discord, warrants exercise of powers under Section 528 of
BNSS.
5. Following principles of law laid down by the Full Bench
Judgment of this Court in "Kulwinder Singh and others Vs. State of Punjab

and another" 2007(3) RCR (Criminal) 1052 1052 and Hon'ble Supreme Court in
"Gian Singh Versus State of Punjab and others" (2012) 10 SCC 303,, the
petition is allowed.
6. Consequently, FIR No.123 dated 07.07.2022, under Sections
323, 406, 498-A 498 A and 506 of Indian Penal Code, Police Station Rewari
Sadar, District Rewari, Rewari and all consequential proceedings arising therefrom,
are quashed qua the petitioners,, on the basis of compromise dated
10.02.2026.
7. Pending applications, if any, stand disposed of.
