ORAL JUDGMENT
Date : 27-02-2026 Heard the parties.
2. Challenge in the present writ petition is made to
the order No. 42-C-13/13/197/2020/E-III dated 23.04.2025
issued by the respondent No. 3, whereby the petitioner has been
placed under suspension with effect from 23.04.2025.
3. Learned Advocate for the petitioner fairly
contended that during the pendency of the writ petition, now the
suspension of the petitioner has been revoked but for the period
during which he was kept under suspension, he has only been
allowed the subsistence allowance. Till date neither any
departmental proceeding has been initiated nor further action Patna High Court CWJC No.20805 of 2025 dt.27-02-2026
has been taken is the submission of learned Advocate for the
petitioner based upon instruction from his client.
4. Learned Advocate for the Union of India prays for
a short adjournment to apprise this Court with respect to the
present factual position.
5. Be that as it may, considering the nature of relief
sought for in the writ petition as also the fact that now the
suspension of the petitioner has already been revoked, this Court
does not find any reason to keep the matter pending.
Accordingly, the present writ petition stands disposed of.
6. However, the petitioner shall be at liberty to file an
appropriate representation before the concerned authority for
payment of his due salary for the period he was put under
suspension after deducting the subsistence allowance. If such
representation is filed, the same shall be considered and
disposed of in accordance with law, expeditiously.
