Heard the learned counsel for the parties.

2. This is an application seeking quashing of the

order dated 28.08.2023 passed by the learned Additional Chief

Judicial Magistrate-I, Benipatti, Madhubani in connection with

Benipatti P.S. Case No. 60 of 2014, whereby cognizance has

been taken against the petitioner under Sections 406, 420 and

120(B) of the Indian Penal Code.

3. After some arguments, the learned counsel for

the petitioner submits that he shall not be pressing the present Patna High Court CR. MISC. No.457 of 2026 dt.13-02-2026

application at present with a liberty that he shall be permitted to

raise all the points available to him at the time of framing of

charge and also bring on record such materials before the

learned Trial Court, which would be of sterling quality and

unimpeachable, and the learned Trial Court should take into

consideration the same and pass an appropriate order in

accordance with law.

4. Permission is accorded.

5. With the aforesaid liberty, the application stands

disposed off.
