ORAL JUDGMENT
Date : 30-01-2025 The matter has been taken up on mentioning being
made on behalf of the petitioner.
02. Heard learned counsel for the petitioner.
03. Learned counsel for the petitioner submits that the
petitioner has approached this Court with limited prayer seeking
direction to the learned Sub Judge-VII, East Muzaffarpur to
dispose of the injunction petition dated 22.07.2024 filed in
Partition Suit No. 221 of 2024, which is pending consideration
before the learned trial court, within a stipulated time period.

Learned counsel further submits that the defendants are trying to
change the nature of the suit property and the learned trial court
has kept the petition filed by the plaintiff seeking injunction
pending.
04. Since the petitioner has approached this Court
with limited prayer for early disposal of petition filed for
injunction in Partition Suit No. 221 of 2024 pending before the
learned trial court, I do not think there is any need to issue
notice to the respondents.
05. In the light of aforesaid facts and circumstances,
the learned Sub Judge-VII, East Muzaffarpur/court concerned is
directed to dispose of the petition dated 22.07.2024 filed for
injunction in Partition Suit No. 221 of 2024 within a month
from the date of receipt/production of a copy of this order, if
appearance is complete and notice of injunction petition has
been received by the parties concerned.
06. With the aforesaid direction, the present petition
stands disposed of.
