                                    ORAL JUDGMENT

1. Heard the Learned counsel for the

petitioner as well as the Learned counsel for the

respondents.

Patna High Court CWJC No.23849 of 2018 dt.22-08-2025

2. The writ petition is filed for the following

reliefs:-

"(i) That the respondent 2nd sets may be directed to immediately remove the transformer installed upon the private raiyati land of the petitioner bearing Khata No. 259, Plot No. 2728, area 41/4 decimal situated in Sri Krishna Memorial Road, New Area, in the township of Nawada.

(ii) That the respondents may be directed to not harass the petitioner and not make demand and cost of estimate and cost of shifting of transformer from the house of the petitioner since the transformer has been fraudulently installed in the private house of petitioner in the absence of the petitioner without obtaining her consent or knowledge and has caused serious prejudice to the petitioner and if any amount is to be realized it should be realized from the pocket of respondent 3rd set who had fraudulently installed the transformer in the vacant position of Private house of petitioner at the instance of some influential local politicians.

(iii) That the respondents may be directed to make payment of Patna High Court CWJC No.23849 of 2018 dt.22-08-2025

compensation of Rs. 10 lacs to the petitioner for unnecessary harassment, litigation cost and mental tension.

(iv) That any other relief or reliefs may be allowed which may be just proper and equitable in the opinion of this Hon'ble Court."

3. At the very outset, Learned counsel for the

respondents contended that since this matter is

squarely covered under the order dated 26.06.2024

passed in CWJC No. 17625 of 2016 (Lalmuni Devi

Vs. The State of Bihar & Ors.) by this Court in

which this Court has passed the order in light of the

judgment passed by the Hon'ble Apex Court in the

case of The Power Grid Corporation of India

Limited vs Century Textiles & Industries Ltd &

Ors. reported in 2017(2) PLJR (SC) 152, this writ

petition may also be disposed of on the same terms

and conditions.

4. After perusal of the aforesaid judgment,

the Learned counsel for the petitioner seeks liberty

to file appropriate application for compensation

before the appropriate forum.

5. Having regard to the submissions made by

the Learned counsel for the petitioner, the present Patna High Court CWJC No.23849 of 2018 dt.22-08-2025

writ petition stands disposed of in terms of the

aforesaid judgment passed in CWJC No. 17625 of

2016 (supra) in light of the judgment passed by the

Hon'ble Apex Court in the case of The Power Grid

Corporation of India Limited (supra) with liberty

to the petitioner to seek necessary compensation by

approaching the concerned District Judge and in

case, any such petition is filed within a period of four

weeks from the date of receipt of copy of this order,

the same shall be examined and considered on

merits by the appropriate forum and shall be

disposed of as expeditiously as possible.

6. With the aforesaid direction the writ

petition stands disposed of.

7. Interlocutory Application, if any, shall

stands disposed of.
