Record taken up on mentioning being made on behalf

of the petitioners.

2. Heard learned counsel for the petitioners and

learned counsel for the respondent no.1.

3. The instant petition has been filed under Article

227 of the Constitution of India seeking direction to the court of

learned Sub Judge-II, Chapra to consider and pass appropriate

orders on the application of the petitioners filed on 05.01.2024

in Title Suit No. 556 of 2003 as early as possible.

4. Since it is the matter seeking direction to the

learned trial court for expeditious disposal of the aforesaid

application dated 05.01.2024, I do not think there is any need to

issue notice to other respondents.

5. Accordingly, the learned Sub Judge-II, Chapra is

directed to dispose of the application dated 05.01.2024 filed by

the petitioners in Title Suit No. 556 of 2003 on its merits and in

accordance with law at the earliest and preferably within a

period of one month from the date of receipt/production of a

copy of this order, after giving due opportunity of hearing to the

parties.

6. The parties are also directed to cooperate in the

matter for its early disposal without seeking unnecessary

adjournment.

7. With the aforementioned observations and

directions, the instant petition stands disposed of.
