appearing on behalf of the petitioner and Mr. Prem Ranjan Raj,

learned counsel representing the State.

2. The matter in issue relates to construction of

Panchayat Sarkar Bhawan at revenue village Patwasarai. Earlier Patna High Court CWJC No.17567 of 2022 dt.10-10-2023

also, some interested persons of the concerned Panchayat had

approached before this Court by filing different writ petitions

and accordingly, the matter has been proceeded and finally in

terms of the order of this Court as well as departmental

guidelines, the District Magistrate, Nawada vide his order dated

05.12.2002 has accorded the permission for the construction of

Panchayat Sarkar Bhawan, after due enquiry in respect thereof,

by the Land Reforms Deputy Collector, Nawada as contained in

Letter No. 537 dated 03.12.2022.

3. In pursuant to the afore-noted order, the District

Panchayati Raj Officer, Nawada vide his Letter No. 2839 dated

05.12.2022 has requested the Executive Engineer, LAEO Work

Division - I, Nawada to expedite the process of construction of

the Panchayat Sarkar Bhawan in Jamuawan Patwasarai over the

land as proposed thereof, pertaining to Khata No. 547, Plot No.

1760, Area 1.41 acres.

4. Learned counsel for the State lastly submitted that

the necessary technical sanction has already been granted by the

competent authority and the process of the tender and the work

will be followed.

5. At this stage, learned counsel for the petitioner

submits that the aforesaid action of the respondent authorities, Patna High Court CWJC No.17567 of 2022 dt.10-10-2023

granting permission for constructing the Panchayat Sarkar

Bhawan at Jamuawan Patwasarai is not in terms of the

guidelines issued by the Bihar Panchayati Raj Department and

thus, he intends to assail the order by filing an appropriate writ

petition. In the aforesaid backdrop, the petitioner prays to

withdraw the present writ application with the liberty aforesaid.

6. In view thereof, the present writ petition stands

disposed of.
