The petitioner had approached this Court against

the order of cancellation of his PDS licence when this Court

had directed the petitioner to prefer an appeal against the

aforesaid order within a period of one month.

Patna High Court CWJC No.917 of 2022 dt.24-02-2022

The petitioner filed an appeal but only after a

delay of five months and the same has been dismissed on

the aforesaid ground viz. late filing of the memo of appeal.

We set aside the appellate order and direct the

appellate authority to advert itself to the grounds taken in

appeal and pass a reasoned order within a period of 60

days from the date of receipt/presentation of a copy of this

order.

Needless to state that the appellate order shall be

a reasoned order, which shall be communicated to the

petitioner.

The writ petition stands disposed off accordingly.
