Heard learned counsel for the parties.

Learned counsel for the petitioner submits that he has

already approached the Court of the SDJM, Khagaria for release

of his vehicle by invoking relevant provisions of the Cr.PC.

However, no decision has been taken thereon. He further contends

that if the vehicle remains in the custody, it shall be reduced to

scrap.

Under the circumstances, we dispose off the writ

petition with a direction to the SDJM, Khagaria to take up the

application on priority and endeavor to decide the same at the

earliest, in any case, not later than one month.

The petition stands disposed off.
