Heard learned counsel for the parties.

The petitioner has impugned the demand notice

whereby he has been asked to pay an amount of Rs. 43 lakhs an

odd, in view of the loan taken by him.

Learned counsel for the petitioner however submits that

there is a possibility of amicable settlement and he may be

allowed to file a representation.

Patna High Court CWJC No.57 of 2021 dt.18-11-2021

We dispose off the writ petition with liberty to the

petitioner to file a representation within one week from today. In

case such a representation is filed, the Bank shall consider the

same sympathetically and take a decision within one week,

thereafter.

Learned counsel for the Bank assures us that in case the

possession of the property has not been taken till now, no further

steps shall be taken in that direction till a decision as aforesaid is

taken by the Bank.

The writ petition stands disposed off.
