Heard the learned counsels for the parties.
2. In the instant petition, petitioners have prayed for Patna High Court CWJC No.6421 of 2020 dt.17-12-2021
following reliefs:
"i. To direct the respondents to regularizes the post of the petitioners who are working in the concerned department since 2010 as a daily wages worker.
ii. To commanding the respondents concerned of the Agriculture department who are taking all kinds of the service of the government from the petitioners.
iii. To direct the respondents to consider over the matter of the petitioners as they were working in the said department last 09 years, which is violation of the fundamental rights of the petitioners enshrined in the constitution of India.
iv. To grant any other relief/reliefs as to which the petitioners are entitled in the fact of circumstances of the case."
3. Concerned respondent in the department of
Agriculture is hereby directed to take note of petitioners' service
particulars and pursuant to that pass speaking order as to whether
petitioners are entitled to regularization in the department in terms
of full bench decision of this Court in case of Ram Sevak Yadav
& Another Vs. The State of Bihar & Others reported in
2013(1) PLJR 964 passed in CWJC No. 267 & 472 of 2010
read with the case of Secy., State of Karnataka V. Uma Devi
reported in (2006)4 SCC page 1 passed in CWJC No. 16 of
2021. Such speaking order shall be passed and communicated to
the petitioners within a period of three months from the date of
receipt of this order.
