  02.        1.      Heard, learned counsel appearing for the appellant.

2. The appellant-husband is before this Court challenging the judgment and decree dated 29.11.2024 passed by the learned Judge, Family Court, Rayagada in Civil Proceeding No.28 of 2024. By the said judgment and decree, the petition filed by the appellant-petitioner-husband in the marriage under section-13(1)(i-

a)(i-b) of the Hindu Marriage Act, 1955 was allowed, thereby dissolving the marriage solemnized on 29.11.2019 between the appellant-husband and the respondent-wife.

2. It is submitted by the learned Counsel for the appellant- husband that the permanent alimony ordered to be paid by the learned Family Judge, Rayagada by the impugned judgment dated 29.11.2024 is exorbitant and is without any qualified reasons. On being asked by the Court to secure the decree for us to interfere, it

is fairly submitted by the learned Advocate that he shall obtain instruction regarding deposit of the amount by the appellant.

4. Issue notice along with this order, subject to the appellant depositing 50% of the amount i.e. Rs.8,00,000/- (Rupees eight lakh) on or before 25th February, 2026 in favour of the Registrar Judicial of this High Court. The amount deposited shall be invested in a high interest yielding short term deposit in any Nationalized Bank with auto renewal clause to the credit of the appeal.

Requisites for issuance of notice by Speed Post with registration and proof of delivery shall be filed within next five working days.

5. List on 19th March, 2026 under the same heading.

6. Head learned counsel for the appellant.

7. Issue notice as above.
