CORAM:

JUSTICE SASHIKANTA MISHRA ORDER_ 15.01.2026 Order No.

1. This matter is taken up through hybrid mode.

33.

2. Learned counsel for the respondent files a memo stating therein that the respondent has moved the Supreme Court by filing SLP against the judgment dated 19.12.2025 passed by this Court in I.A. No. 129 of 2025. The memo only indicates the diary number of the case supposedly filed.

3. Mr. Das, learned counsel for the Election Petitioner opposes the move by submitting that mere filing of an SLP cannot operate as stay.

4. Nevertheless, having regard to the fact that the Supreme Court has already been moved, this Court is inclined to grant three weeks' time in the respondent to obtain appropriate orders.

5. List this matter on 09.02.2026.
