    02.        1.    This matter is taken up through Hybrid Arrangement (Virtual
               /Physical Mode).

2. Heard learned counsel for the Defendant No.4-Petitioner in C.S. No.611 of 2010. Perused the CMP application as well as the prayer made therein.

3. By filing the present application under Article 227 of the constitution of India, the Defendant No.4 in the suit has approached this Court challenging the order dated 22.08.2025 passed by the learned Civil Judge, Senior Division, 2nd Addl. Court, Cuttack in C.S. No.611 of 2010, thereby allowing the petition under Order 22 Rule 3 CPC read with Order 22 Rule 9 CPC.

4. Learned counsel for the Petitioner, at the outset, contended that while passing the order dated 22.08.2025, the learned trial court

has not followed the procedure as laid down in Order 22 of the CPC. However, he further contended, that the Petitioner does not want to raise this application at this stage. Instead the learned trial court may be directed to expedite the trial in the suit and conclude the same as expeditiously as possible.

5. Considering the fact that the suit is of the year 2010, and in the meantime more than one and half decades have already elapsed, this Court, without interfering with impugned order, directs the learned trial court to expedite the trial in the suit and make every endeavour to conclude the same as expeditiously as possible. The Parties are directed to cooperate with the learned trial court for an early conclusion of the trial and shall not take any unnecessary adjournments.

6. With the aforesaid observations and directions, the CMP application stands disposed of.
