02. 1. Heard learned counsel for the respective parties.

2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Balasore Sadar P.S. Case No.574 of 2025 corresponding to C.T. Case No.1011 of 2025 pending in the court of learned J.M.F.C.(City), Balasore on the grounds stated.

3. Gone through the FIR as at Annexure-1. The informant's husband is said to have been assaulted by the petitioner during the incident. According to the learned counsel for the petitioners, no serious injury has been received by the victim. Learned counsel for the State produced the medical examination reports and the same are perused. One of the victims examined on police requisition did have a facture injury, but the other injured, namely, husband of the informant received injuries but all are stated to be simple in nature with opinion therein that the injuries might have been caused by

hard and blunt weapons. The reason behind the alleged incident is narrated in the FIR, the petitioners alleged to have abused the informant's husband in filthy language and thereafter, said to have committed the excess. It is claimed that the petitioners do not have any antecedents and first-time offenders. Considering the above facts and submissions of learned counsel for the respective parties and the medical examination report of the husband of the informant, who stated to have received no grievous injury, this Court is not inclined to grant pre-arrest bail to the petitioners, however, is of the view that they should be directed to surrender before ethe learned court below for being released with suitable conditions imposed.

4. Hence, it is ordered.

In the result, the ABLAPL petition stands disposed of with a direction to the petitioners to surrender before learned J J.M.F.C.(City), Balasore within a fortnight from today and in the event of their surrender in compliance thereof, they shall be released on bail in connection with C.T. Case No.1011 of 2025 on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall not commit any further mischief involving the informant and her husband in any manner, whatsoever and in the meantime, to cooperate the I.O. in the investigation as and when required till its completion.

6. Issue urgent certified copy of this order as per rules.
