                      BLAPL No.13840 of 2025
Prakash Kumar Swain @ Funu ... Petitioner
                                                   Mr. R.R. Ray, Advocate
                                  -versus-
State of Orissa ... Opposite Party
                                              Mr. C. Mahanty, Addl. PP

                                 CORAM:
                          JUSTICE G. SATAPATHY
                              ORDER(ORAL)
Order No. 10.02.2026
   01. I.A. No. 115 of 2026
             1. This matter is taken up through Hybrid

Arrangement (Virtual/Physical Mode).

2. This is an application by the petitioner for grant of interim bail to attend the post obsequies of his late mother, who is stated to have died on 06.02.2026.

3. Heard, Mr. Rohit Ranjan Ray, learned counsel for the petitioner appearing virtually and Mr. C. Mahanty, learned Additional Public Prosecutor in the matter and perused the record.

4. After having considered the rival submissions and on going through the averments taken in the IA together with the documents annexed thereto, since the petitioner wants to avail interim bail to attend the post obsequies of his late mother, who is stated to have died on 06.02.2026, this Court by keeping the regular bail application pending grants interim bail to the petitioner purely on humanitarian ground for a period of

15(Fifteen) days with effect from the date of his actual release on bail on such terms and conditions as deem fit and proper by the learned Court in seisin of the case including one condition that one of the sureties must be either his blood relation or family member.

5. The petitioner is, however, advised to surrender to custody after expiry of the interim bail, failing which the Court in seisin of the case may take coercive steps to recommit the petitioner to jail custody.

6. Hence, the IA stands disposed of. Issue urgent certified copy of this order as per Rules. The benefit of this order shall not be extended to the petitioner, if the news relating to death of wife of the petitioner is found to be false.

7. List this matter on 27.02.2026.
