01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is an accused in connection with CT(N) Case No.68 of 2026, pending on the file of learned Special Judge, Phulbani, Kandhamala, arising out of Phulbani Sadar P.S. Case No.34 of 2026 for commission of the alleged offence under Sections 20(b)(ii)(C)/25/29 of NDPS Act.

3. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.

4. Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned Special

Judge, Phulbani by order dated 17.02.2026 in the aforementioned case, the present BLAPL has been filed.

5. Learned counsel for the State opposes the prayer for bail.

6. Taking into account that the contraband (ganja) seized is to the tune of 21Kg, though it is urged with vehemence that since the same recovered from two persons, the rigors of Section 37(1)(b)(ii) of NDPS Act is not attracted, this Court is not inclined to entertain this bail application at this stage since admittedly the investigation is in progress.

7. Liberty is granted to the Petitioner to renew his prayer before the learned Court in seisin which shall be considered on its own merit.

8. Accordingly, the BLAPL stands disposed of.

9. Urgent certified copy of this order be granted as per rules.
