05. 1. This I.A. has been filed for extension of time fixed by this Court

for surrender of the appellant before the Court of Special Judge

(Vigilance), Bhubaneswar.

2. By order dated 20.02.2026 while admitting the appeal, in I.A.

No.283 of 2026 this Court had directed that the appellant on

surrendering before the learned trial Court within four weeks shall be

released on bail pending disposal of the criminal appeal on such terms

and conditions may be fixed by the Court. The period expired on

19.03.2026.

3. In paragraph -3 of the I.A. it has been stated that due to severe

Diabetes which causes vomiting, the appellant had consulted the Doctor, who advised him to take medicine and take rest for one month or till

control of the Diabetes. Therefore, the appellant could not surrender

before the learned Special Judge (Vigilance), Bhubaneswar in T.R. Case

No. 37 of 2010 within the time stipulated by this Court.

4. The affidavit has been sworn by one Dillip Kumar Mallick,

Advocate's Clerk who has stated that the facts stated in Paragraphs-1 to

3 are true to the best of information which he has obtained from personal

sources and he believes the information to be true basing upon in the

records and information. This declaration is totally incorrect as neither

the appellant is related to the deponent nor was any document filed with

the I.A.

5. A prescription dated 17.03.2026 of Dr. Payod Kumar Jena,

Consultant Neurologist has been filed along with a memo, subsequently.

The same is illegible. The learned counsel is directed to file a typed copy

of the prescription within two weeks.

6. Learned counsel for the appellant submits that as per order dated

24.03.2026 passed in I.A. No.633 of 2026, the appellant deposited an

amount of Rs.20,000/- towards fine amount today.

7. Considering the fact that the fine amount as directed by this

Court has already been deposited by the appellant, the date of surrender

as fixed by this Court vide order dated 20.02.2026 in I.A. No.283 of

2026, is extended by a period of two weeks from today.

8. The I.A. is accordingly disposed of.

9. List this case on 22.07.2026 as directed.
