1. This matter is taken up through hybrid arrangement.

2. Heard.

3. There shall be stay realization of fine till disposal of this

appeal.

4. The I.A is accordingly disposed of.

5. This is an application under section 389 of the Cr.P.C. for

suspension of execution of sentence imposed upon the

Appellant, namely, Rabinarayan Sahu by the Trial Court while

convicting him for the offence under section 20(b)(ii)(C) of

N.D.P.S. Act and his release on bail pending disposal of this

Appeal.

6. Learned Counsel for the Appellant, at the outset, instead

of three months and accordingly, prays for disposal of this

interlocutory application.

7. Learned counsel for the Appellant submits that the

Appellant being in custody for more than six years and one

month by now, his family members are suffering a lot without

getting his help. He further submits that the family members of

the Appellant having somehow managed to pull on the

situation till now, they are no more in a position to continue

further without the help and assistance of this Appellant.

In view of all these above, he urges for interim bail to the

Appellant to remain present at home for some period.

8. Learned counsel for the State opposes the move.

9. Taking into account the submissions made and on going

through the averments taken in the application; while being

inclined to grant the prayer for interim bail to the Appellant; it

is directed that the Appellant be released on interim bail for a

period of 03 (three) months from the date of his actual release

from custody by the learned 1st Additional Sessions Judge-cum-

Special Judge(N.D.P.S), Berhampur, Ganjam in Case No.2(a)CC

No.13/2019(N) on such terms and conditions as deemed just and

proper and he will positively surrender before the learned court

in seisin of the case on the date as would be so directed.
