01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Gopalpur PS Case No.126 of 2025 corresponding to ST Case No.287 of 2025 (GR Case No.645 of 2025) pending in the file of learned 1st Additional Sessions Judge, Berhampur, Ganjam, for commission of offences punishable U/Ss.103(1)/3(5) of BNS, on the main allegation of committing murder of one Anjali Sahu by trespassing into her house, along with co-accused persons.

3. Heard, Mr. Santosh Kumar Mahanty, learned counsel for the petitioner and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record.

4. After having considered the rival submissions upon perusal of record, there appears allegation against the petitioner for committing murder of the deceased Anjali Sahu by assaulting her with crowbar and the

charge-sheet filed in this case indicates the alleged involvement of the present petitioner. In the aforesaid facts and circumstance and taking into account the nature and gravity of the offences as alleged against the petitioner vis-à-vis the allegation sought to be brought against him and regard being had to the statement of the witness Ravi Sethi and keeping in view the other circumstances on record in entirety including the circumstance of previous harassment of the deceased allegedly by the present petitioner, this Court is not inclined to grant bail to the petitioner.

5. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A copy of this order be immediately transmitted to the learned Court in seisin over the matter.
