    01.        1.       This matter is taken up through Hybrid Arrangement (Virtual
               /Physical Mode).

2. This is an application for condonation of delay in preferring the appeal before this Court.

3. Heard learned counsel for the Appellant as well as learned counsel for the State.

4. Learned counsel for the Appellant-Petitioner contended that there exists a delay of 33 days in preparing and presenting the appeal before this Court. Learned counsel for the Appellant-Petitioner further contended that the Appellant-Petitioner has preferred the present appeal against judgment dated 04.02.2025 passed in Special case No.60 of 2021 by the Ad-hoc Additional Sessions Judge (FTSC), Keonjhar, thereby convicting the Appellant under Section 376(3), 366, 34 of I.P.C. read with Section 6 POCSO Act and the

Appellant-Petitioner has been sentenced to undergo maximum RI for 20 years. Learned counsel for the Appellant-Petitioner further contended that Appellant-Petitioner is in custody, therefore he could not arrange a lawyer to file present appeal.

5. Having heard the learned counsels appearing for sides. This Court is inclined to condone the delay of 33 days in preferring a present appeal and accordingly, the same is hereby condoned.

6. Accordingly, I.A. stands disposed of.

7. Heard learned counsel for the Appellant.

8. Admit.

9. Call for the digitized copy of the LCR.

10. Issue notice to the Respondent No.2-Informant by Registered Post with A.D. by fixing a short returnable date. Requisites be filed within three working days.

11. Extra copy of the application also be served on learned counsel for the State who shall ensure the service of the notice through the local police on the informant.

12. List this matter in the week commencing 13th October, 2025.
