13. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
This is an application for bail filed by the appellant No.2-Ranjan Parida.
Heard learned counsel for the appellant and the learned counsel for the State.
The appellant-Ranjan Parida has been convicted under Sections 302/304(B)/498-A of the Indian Penal Code read with Section 4 of the D.P. Act and was sentenced to undergo rigorous imprisonment for life and to pay a fine of
Rs.5,000/- (rupees five thousand) in default, to undergo R.I. for one year for the offence under section 302/34 of the Indian Penal Code. He is further sentenced to undergo R.I. for ten years for the offence under Section 304-B/34 of I.P.C., to undergo R.I. for three years and to pay a fine of Rs.1,000/- (rupees one thousand), in default, to undergo R.I. for three months for the offence under Section 498-A of I.P.C. and to undergo R.I. for six months for the offence under Section 4 of the D.P. Act and all the sentences were directed to run concurrently, as directed by the learned 3rd Additional Sessions Judge, Cuttack in S.T. Case No.141 of 2016 arising out of Kandarpur P.S. Case No.19 of 2015.
Perused the impugned judgment.
Learned counsel for the State has produced the custody certificate received from the Senior Superintendent Circle Jail, Cuttack, which shows that including the period of earned remission, the petitioner has remained in custody for ten years eight months twenty-days. He has also produced the report of I.I.C., Kandarpur Police Station to show that during interim bail period, the conduct of the appellant was good. He has also produced another certificate issued by the Senior Superintendent, Circile Jail, Cuttack at Choudwar, which indicates that the conduct of the petitioner inside the jail was satisfactory and he has shown discipline, obedience towards jail rules, willingness to work and participation in the vocational programs. The reports are taken on record.
In view of the period of detention of the petitioner in judicial custody, since the petitioner has not mis-utilised the
liberty while on interim bail and there is no chance of early hearing of the appeal and the fact that two co-convicts have already been granted bail by this Court, we are inclined to release the appellant No.2-Ranjan Parida on bail.
Let the appellant-petitioner No.2-Ranjan Parida be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000/-(rupees twenty thousand) with one local solvent surety for the like amount to the satisfaction of the learned trial Court, subject to the condition that while on bail the appellant-petitioner shall not indulge in any criminal activities in any manner.
Violation of any of the conditions shall entail cancellation of the bail.
Let a copy of the order be communicated by the Registrar (Judicial) to the concerned Jail Superintendent and also to the learned 3rd Additional Sessions Judge, Cuttack by e-mail for compliance.
The I.A. is disposed of accordingly.
Issue urgent certified copy of this order as per rules.
