12.11.2025 Order No. I.A. No.339 of 2025

04. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. This interlocutory application has been filed at the instance of the Petitioner-Appellant for his release on interim bail on the ground of illness of his father.

3. Learned counsel for the Petitioner-Appellant, at the outset, contended that the Petitioner-Appellant having been convicted by the learned Additional District & Sessions Judge-cum-Special Judge (POCSO), Keonjhar in Special Case No.361/35 of 2022-2019 vide judgment dated 11th October, 2023 has approached this Court by filing the above noted appeal. During the pendency of the appeal, the Petitioner-Appellant came to learn that his father is ailing. Learned counsel for the Petitioner-Appellant further submitted that the Petitioner-Appellant is in judicial custody for more than six

years.

4. Learned counsel for the State-Respondent, on the other hand, objected to the release of the Petitioner-Appellant on interim bail on the ground that the condition of the father is stable as per the report of the IIC of the Anandapur Police Station dated 29.10.2025.

5. Taking into consideration the submissions made by the learned counsels appearing for the respective parties, this Court directs that the Petitioner-Appellant be released on interim bail for a period of two weeks from the date of his release in Special Case No.361/35 of 2022-2019 by the learned Additional District & Sessions Judge-cum-Special Judge (POCSO), Keonjhar or the court in seisin over the matter on such terms and conditions as it may deem it just and proper.

6. It is further made clear that on expiry of interim bail period, the Petitioner-Appellant shall surrender before the court below positively.

7. The I.A. is disposed of accordingly.

8. Urgent certified copy of this order be granted on proper application.

9. List this appeal in the week commencing 8th December, 2025. Surrender certificate be filed by the next date positively.
