01. 1. Heard learned counsel for the petitioner.

2. Instant revision is filed by the petitioner assailing the impugned judgment in Criminal Appeal No.09 of 2021 as at Annexure-2 on the grounds stated.

3. The petitioner stands convicted for an offence under Section 138 of the N.I. Act and has been directed to undergo sentence of SI for two years and to pay compensation of Rs.37, 10,500/- besides cost of Rs.2 lac payable to the opposite party.

4. Considering the facts pleaded on record and the grounds stated challenging the decision of the Court of appeal, the Court is inclined to issue notice to the opposite party for a reply and response.

5. Hence, it is ordered.

6. Issue notice to the opposite party by Speed Post with a short returnable date and for the said purpose, requisites shall

be filed by learned counsel for the petitioner within seven days from today.

7. List on 11th December, 2025 for hearing and orders.

02. 1. Heard.

2. Instant I.As. are filed for interim orders.

3. It is submitted that the petitioner is on bail at present. Considering the plea of the petitioner challenging the impugned decisions of the learned courts below and awaiting reply of the opposite party, this Court, as an interim measure, allows the petitioner to go on bail in connection with 1.C.C. Case No.147 of 2013 subject to suitable conditions imposed by the learned J.M.F.C., Betnoti besides to furnish a deposit of Rs.1 lac to be kept in a fixed deposit on such terms with any Nationalized Bank for such period renewable from time to time. The Court is also inclined to stay realization of the compensation and the cost awarded against the petitioner until further orders but subject to the above conditions fulfilled.

4. List on the date fixed for orders.

5. Issue urgent certified copy of this order as per rules.
