03. This matter is taken up through hybrid mode.
2. Learned Counsel for the Petitioner is absent on call.
3. Though notice was issued to the sole Opposite Party, the same has returned undelivered with postal endorsement "Addressee left so returned to the sender".
4. Hence, in view of the postal endorsement so also judgments of the Supreme Court reported in (1989) 1 SCC 264 (M/s. Madan & Co. Vs. Wazir Jaivir Chand) and in (2007) 6 SCC 555 (C.C. Alivi Haji Vs. Palapetty Muhammed & anr.), notice on the sole Opposite Party is held to be sufficient.
5. Since the Counsel for the Petitioner is absent on call, the matter stands adjourned, to be listed in the week commencing from 26th January, 2026.
6. In the meantime, Office is directed to communicate a copy of this order urgently to the learned Senior Civil Judge, Kamakhyanagar, who shall do well to communicate the same to the present Opposite Party, who is the Petitioner in MAT Case No.31 of 2017 or his Counsel, who was representing him in the said case and report compliance before the next date of listing.
