03. 1. It is submitted by the learned counsel Mr. Acharya for the
appellant that the appellant has obtained change, and he has given consent for the appellant to engage any other counsel. Accordingly, name of Mr. Acharya, learned counsel shall be deleted from the cause list as well as the case brief as counsel for appellant.
2. It is submitted by Mr. Sai Subham, learned counsel that the appellant has engaged him as a counsel.
It is also submitted that he has filed his Vakalatnama along with appearance memo of Mr. Subir Palit, learned Senior Advocate for the appellant.
Name of Mr. Palit, learned Senior Advocate along with Mr. Sai Subham, learned Advocate shall be indicated in the cause list as well as in the case brief appearing for the appellant.
3. Pursuant to our order dated 13th October, 2025, copy of the appeal memo along I.A. and annexures has been served on Mr. Rath, who endorses the service being present in VC.
4. The Caveat No.150 of 2024 stands discharged.
The Caveat Petition is disposed of.
5. Heard learned Senior Advocate on behalf of the appellant.
6. Issue notice on admission.
The learned Additional Government Advocate upon advance copy served appears and waives notice on behalf of opposite parties No.1 & 2.
Since the learned counsel Mr. Rath has already entered appearance and has been served with copies of appeal memo and I.A. No further notice be issued.
7. List under the heading 'For Admission' on 18th December, 2025.
8. Heard learned Senior Counsel for the appellant.
The I.A. has been filed seeking a prayer stay of operation of the judgment dated 24th July, 2024 passed by the learned Single Judge in W.P.(C) No.12516 of 2020.
9. Issue notice.
Since the learned counsel for the respondents have appeared and have been served appeal memo. No further notice be issued.
10. As an interim measure, it is directed the operation of the impugned judgment dated 24th July, 2024 shall remain stayed till the next date of hearing.
Without prejudice to the rights and contentions of the parties, it is further directed that any action taken in the meantime during pendency of the Writ Petition as well as the Writ Appeal shall be subject to the further orders in the Writ Appeal.
