01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard learned counsel for the Petitioner as well as learned counsel for the State-Opposite Parties. Perused the writ petition as well as the documents annexed thereto.
3. The present writ petition has been filed by the Petitioner with the following prayers:-
"In view of the aforesaid facts and circumstances as narrated above it is prayed that this Hon'ble Court be graciously be pleased to admit the Writ Petition and issue Rule Nisi or any other appropriate Writs against the Opp. parties calling upon the opposite parties to show cause as to why they shall not be directed to extend the petitioner the
retirement benefits in view of the resolution at Annexure-14 after absorbing him with effect from the order at Annexure-12;
And, if the Opp. Parties failed to show cause or show insufficient cause, make the said Rule absolute by directing the Opp. Parties to extend the petitioner the retirement benefits in view of the resolution at Annexure-14 after absorbing him with effect from the order at Annexure-12.
And/or issue any other appropriate Writ/Writs, order/orders, direction/directions as deem fit and proper in the fitness of the case."
4. It is submitted by the learned counsel for the Petitioner that the Petitioner wants to make a fresh representation before the authority concerned with a direction from this Court to the authority to consider the case of the Petitioner within a stipulated period of time.
5. Learned counsel for the State-Opposite Parties submits that he has no objection if the Petitioner is permitted to file a fresh representation before the authority concerned with a direction to the authority concerned to consider the representation of the Petitioner in accordance with law within a stipulated period of time.
6. Considering such submission and without expressing any opinion on the merit of the case, this Court disposes of the writ petition permitting the Petitioner to make a fresh representation taking therein all the grounds along with copies of the judgments that he relied upon before the Opposite Party No.1 within three
weeks from today and in such event the representation filed by the Petitioner, the Opposite Party No.1 shall do well to consider the case of the Petitioner in the light of the judgments referred by the Petitioner in his representation and dispose of the same by passing a speaking and reasoned order within a period of three months from the date of filing of such representation. The decision so taken on such representation shall be communicated to the Petitioner within ten days thereafter.
